ALOCASIA CORMS.COM — TERMS & CONDITIONS

By accessing, browsing, or placing an order on AlocasiaCorms.com ("the Site," "we," "us," "our"), you ("the Customer," "you") agree to be bound by the following Terms & Conditions in full. If you do not agree, do not use the Site or place an order.

1. NATURE OF PRODUCTS
All products sold on this Site are living plant material (corms, tubers, bulbs, and related plant products). Living organisms are inherently variable. By purchasing, you acknowledge and accept that:
- No two corms are genetically or visually identical, even within the same variety or clone line.
- Photos and listing descriptions represent the typical appearance of the species/variety and, unless a listing explicitly states "this exact corm pictured," are representative only, not a guarantee of the specific specimen received.
- Size, coloration, and variegation pattern of any resulting growth cannot be predicted or guaranteed by the seller.

2. VARIEGATION & APPEARANCE DISCLAIMER
Variegation, coloration, and pattern in aroids and related plants are the result of genetic instability and are never guaranteed, whether the listing is labeled "variegated," "high variegation," "half-moon," or similar terminology. Genetics can:
- Revert to solid green growth
- Produce lower variegation than the parent plant or previous growth shown
- Fail to display variegation at all in a given growth cycle

No refund, replacement, or store credit will be issued based on variegation percentage, pattern, or color of subsequent growth after the corm has arrived alive and as described at the species/variety level. This is the single largest source of disputes in the aroid industry, and it is final and non-negotiable.

3. ALL SALES FINAL — NO GUARANTEES OF ANY KIND
We do not offer a live arrival guarantee. All sales are final. We do not offer refunds, replacements, exchanges, or store credit for any reason once an order has shipped, including but not limited to:
- The corm arriving dead, damaged, diseased, or in poor condition
- Size, appearance, or variegation different than expected
- Delays, temperature exposure, or mishandling in transit by the carrier
- Any dissatisfaction after delivery

By completing a purchase, you affirmatively acknowledge that you are buying a living, perishable agricultural product, that shipping carries inherent risk beyond our control once the package leaves our facility, and that you accept that risk in full as a condition of this sale.

4. BUYER ACKNOWLEDGMENT
Placing an order on this Site constitutes your express acknowledgment and acceptance of Sections 2 and 3 above. We recommend reviewing this policy in full before purchasing; questions about a specific corm should be directed to us through our Contact page prior to ordering.

5. ORDER ACCEPTANCE & CANCELLATION
- All orders are subject to acceptance and available stock. We reserve the right to cancel or refuse any order for any reason, including suspected fraud, pricing errors, or inventory error, with a full refund issued for any order we cancel.
- Cancellation requests by the customer are accepted only if the order has not yet shipped. Once a shipping label is created, the order cannot be cancelled.

6. SHIPPING & RISK OF LOSS
See our full Shipping Policy. Risk of loss, damage, or condition in transit is the customer's responsibility once the package is scanned into the carrier's system — see Section 3.

7. DISCLAIMER OF WARRANTIES
ALL PRODUCTS ARE SOLD "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE APPLICABLE JURISDICTION. Some states do not allow the exclusion of certain implied warranties for consumer goods, in which case this disclaimer applies only to the fullest extent that state law permits, and does not waive any warranty protection that cannot lawfully be waived in your state.

8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, AlocasiaCorms.com's total liability for any claim arising from your order — whether in contract, warranty, tort, or otherwise — is limited to the purchase price paid for the specific item(s) at issue, and in no event will we be liable for incidental, consequential, indirect, special, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.

9. INDEMNIFICATION
You agree to indemnify and hold harmless AlocasiaCorms.com, its owners, and employees from any claim, loss, or damage (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party right.

10. DISPUTE RESOLUTION — BINDING ARBITRATION & CLASS ACTION WAIVER
Any dispute arising out of or relating to these Terms or any purchase shall be resolved exclusively through binding, individual arbitration administered by [American Arbitration Association / JAMS], rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
You and AlocasiaCorms.com each waive any right to a jury trial and to participate in a class action, class arbitration, or representative action.
Note: A small number of states restrict or prohibit mandatory consumer arbitration/class-action waivers. Where unenforceable, that portion severs and the remaining terms stay in effect (see Section 13).

11. GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to Section 10, exclusive venue for any permitted court proceeding is the state or federal courts located in Citrus County, Florida.

12. FORCE MAJEURE
We are not liable for delay or failure to perform due to causes beyond our reasonable control, including extreme weather, carrier disruption, natural disaster, labor dispute, or government action.

13. SEVERABILITY
If any provision of these Terms is found unenforceable under a particular state's law, that provision will be limited or severed to the minimum extent necessary, and the remainder of these Terms will remain in full force and effect.

14. CHANGES TO THESE TERMS
We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
